ICOs are still not regulated by law in Austria. The token sale is judged according to general tax rules, so a tax liability (measured according to the capital gain, i.e. the difference between the acquisition cost and the sale proceeds) arises if the token is sold within one year of acquisition (from the point it is available in the "virtual wallet"). Since the tokens issued by an ICO are usually related to the business model of the company, it must always be carefully examined here whether a VAT exemption can be considered.
